EXECUTIVE SUMMARY

These Terms and Conditions explain how GoCareer Consulting Ltd provides its career services, what you can expect from us, and what we ask of you as our client. They form the legal agreement between you and GoCareer when you purchase or use our services.

We provide professional career consultancy services, including CV writing, LinkedIn optimisation, interview coaching, career coaching, managed job applications, and job search support. We are not a recruitment agency or employer, and we do not make hiring decisions.

Your Responsibilities

To help us deliver the best possible service, you must provide accurate information, respond to requests promptly, review documents carefully, and actively participate in your job search.

Fees, Cancellations, And Refunds

Our services are highly personalised. Once work has started, cancellation and refund rights may be limited, although your statutory consumer rights are always protected.

Guarantees

Where included in your package, our Interview Guarantee, Job Offer Guarantee, and Job Loss Protection are service continuation commitments. They provide additional support if certain milestones are not achieved—they are not guarantees of employment, interviews, or refunds.

Employment Outcomes

While we use reasonable skill and care in delivering our services, recruitment decisions are made solely by employers, and we cannot guarantee interviews, job offers, salary levels, or employment.

Privacy And Confidentiality

We handle your personal information in accordance with UK data protection law and our Privacy Policy, and both parties agree to keep confidential information secure.

Liability

Our liability is limited as set out in these Terms, but nothing excludes or limits liability where this would be unlawful, and your statutory consumer rights remain unaffected.

Governing Law

These Terms are governed by the laws of England and Wales.

1. INTRODUCTION

These Terms and Conditions (“Terms”) govern the provision of services by GoCareer Consulting Ltd, a company incorporated in England and Wales (Company No. 16197930) with its registered office at 128 City Road, London, EC1V 2NX (“GoCareer”, “we”, “us”, “our”).
These Terms constitute the entire contractual agreement between GoCareer and the individual or organisation purchasing our services (“Client”, “you” or “your”).

By purchasing or using any GoCareer service, you confirm that you have read, understood and agreed to be legally bound by these Terms.

If you do not agree with any part of these Terms, you must not purchase or continue using our services.

2. DEFINITIONS

Application Allocation

The number of managed job applications included within the Client’s purchased Elevate package.

Business Day

Any day other than a Saturday, Sunday or public holiday in England.

Client

The individual purchasing or receiving services from GoCareer.

Career Materials

Any documents created by GoCareer.

Consultation

Any scheduled telephone, video or, written consultation provided by GoCareer.

Elevate Programme

GoCareer’s managed job search service as described on our website.

Elevate Lite

The standard managed application package including ten (10) managed job applications and associated career services.

Elevate Pro

The premium managed application package including twenty (20) managed job applications and associated career services.

Guarantee

Any service continuation commitment described in Section 10 of these Terms.

Interview

A genuine invitation from an employer or authorised recruiter to participate in a formal recruitment process for a position that reasonably aligns with the Client’s agreed target roles.

An interview may be conducted in person, remotely, by telephone, or via video conferencing.

Automated screening questionnaires, psychometric testing, AI assessments, one-way video recordings or general networking conversations shall not constitute an Interview unless GoCareer expressly agrees otherwise.

Job Offer

A genuine offer of employment issued by an employer following a recruitment process.

A Job Offer may be permanent or fixed-term unless otherwise agreed.

Conditional offers remain qualifying offers where the stated conditions are routine employment conditions including references, right-to-work checks, or background screening.

Managed Applications

Job applications submitted by GoCareer on behalf of the Client where such service forms part of the purchased package.

Services

All career-related services supplied by GoCareer.

3. ABOUT GOCAREER

GoCareer is a specialist career consultancy providing professional career support services designed to assist individuals in improving their employment prospects.

Our services may include:

  • career consultations;
  • career coaching;
  • CV and cover letter writing and optimisation;
  • LinkedIn profile writing and optimisation;
  • interview coaching and preparation;
  • salary negotiation guidance;
  • job search strategy;
  • job market analysis;
  • managed application services;
  • networking strategies and outreach support; and
  • digital tools and resources.

GoCareer is not:

  • a recruitment agency;
  • an employment business;
  • a staffing company;
  • a labour provider;
  • an employer;
  • a headhunter acting on behalf of employers; or
  • a provider of employment opportunities.

GoCareer introduces no contractual relationship between Clients and prospective employers.

All recruitment decisions are made exclusively by third-party employers.

Nothing contained within these Terms shall be interpreted as creating any obligation upon any employer to interview or employ a Client.

4. OUR SERVICES

GoCareer agrees to exercise reasonable skill and care in providing the Services in accordance with:

  • these Terms;
  • any written proposal accepted by the Client;
  • the purchased package description; and
  • applicable laws and regulations.

GoCareer may utilise employees, contractors, or specialist consultants to deliver Services.

GoCareer reserves the right to improve, modify or update its methodologies, technology, software platforms, workflows, or delivery processes where doing so does not materially reduce the overall nature of the Services purchased.

Estimated delivery times published on our website are estimates only and are not guaranteed unless expressly stated otherwise.

Where delays occur due to circumstances outside GoCareer’s reasonable control, GoCareer shall use reasonable endeavours to minimise those delays but shall not be liable for any resulting loss.

5. ACCEPTANCE OF SERVICES

By placing an order, making payment, entering into a payment plan, or otherwise instructing GoCareer to commence work, the Client confirms that:

  • they are at least eighteen (18) years of age or otherwise have legal capacity to enter into a binding contract;
  • all information supplied is accurate and complete to the best of their knowledge;
  • they have authority to provide any documents submitted to GoCareer;
  • they understand the nature of the Services being purchased; and
  • they agree to these Terms in full.

Where Services commence immediately following purchase, the Client expressly requests immediate performance of the contract.

Where applicable under consumer legislation, the Client acknowledges that certain digital content and personalised services may commence immediately upon purchase and that statutory cancellation rights may be affected in accordance with applicable law. This clause does not exclude or restrict any mandatory statutory consumer rights.

6. CLIENT RESPONSIBILITIES

6.1 GENERAL OBLIGATIONS

The Client agrees to participate actively and in good faith throughout the provision of the Services.

The Client shall:

  1. provide complete, accurate and truthful information;
  2. promptly disclose any information that may materially affect the Services;
  3. respond to GoCareer communications within a reasonable period;
  4. provide requested documentation promptly;
  5. review and approve draft documents within a reasonable timeframe;
  6. Attend scheduled consultations, coaching sessions and interviews;
  7. notify GoCareer of interview invitations, interview outcomes and employment offers;
  8. comply with agreed job search strategies where applicable;
  9. maintain professional conduct during all recruitment activities;
  10. notify GoCareer immediately of any significant change to employment status, availability, visa status, right to work, career objectives or personal circumstances that could reasonably affect delivery of the Services.

6.2 ACCURACY OF INFORMATION

The Client warrants that all information supplied is true, accurate, and complete to the best of their knowledge.

GoCareer shall not be responsible for any loss, delay or adverse outcome arising from inaccurate, incomplete, or misleading information supplied by the Client.

6.3 REVIEW OF DELIVERABLES

Where GoCareer prepares Career Materials, the Client is responsible for reviewing all documents before they are used.

Approval of any document confirms that the Client is satisfied that:

  • factual information is accurate;
  • employment history is correct;
  • qualifications are correct;
  • dates are accurate;
  • achievements are accurately represented; and
  • no misleading information has been included.

The Client remains solely responsible for information ultimately submitted to prospective employers.

6.4 COMMUNICATION

Unless otherwise agreed, Clients should respond to requests for information within five (5) Business Days.

If no response is received within fourteen (14) consecutive calendar days, GoCareer may:

  • pause the Services;
  • suspend managed application activity;
  • postpone delivery deadlines;
  • suspend any applicable guarantee period where appropriate; or
  • terminate the agreement in accordance with Section 24.

Where delays are caused by Client inactivity, GoCareer shall not be responsible for any resulting loss of opportunity.

6.5 ATTENDANCE

Where interviews or coaching sessions are arranged, the Client agrees to attend punctually.

Failure to attend without reasonable notice may affect guarantee eligibility where attendance formed part of the agreed programme.

6.6 PROFESSIONAL CONDUCT

The Client agrees to conduct themselves professionally when communicating with employers, recruiters, and GoCareer representatives.

GoCareer reserves the right to terminate Services where abusive, threatening, discriminatory, or inappropriate behaviour occurs.

7. FEES AND PAYMENT

7.1 FEES

The fees payable for the Services shall be those published on GoCareer’s website or otherwise agreed in writing at the time of purchase.

Unless expressly stated otherwise:

  • prices are quoted in Pounds Sterling (£);
  • VAT shall be charged where applicable;
  • payment processing fees may apply where disclosed before purchase.

7.2 PAYMENT METHODS

GoCareer may accept payment through approved third-party payment providers, including debit cards, credit cards, and authorised instalment providers.

Acceptance of a payment method does not constitute endorsement of that provider’s services.

7.3 INSTALMENT PLANS

Where payment is made by instalments:

  1. the total contract price remains payable;
  2. instalments represent payment of one overall contract and not separate services;
  3. failure to complete instalment payments shall constitute breach of contract.

GoCareer reserves the right to suspend Services while overdue payments remain outstanding.

7.4 LATE PAYMENTS

Where payment remains outstanding, GoCareer may:

  • suspend Services;
  • pause managed applications;
  • postpone consultations;
  • suspend guarantee eligibility;
  • recover outstanding sums through lawful debt recovery procedures.

Nothing in this clause limits any statutory rights available to GoCareer.

8. CANCELLATION RIGHTS

8.1 CONSUMER CANCELLATION RIGHTS

Where the Client is a consumer located within the United Kingdom or another jurisdiction providing mandatory cancellation rights, those statutory rights shall apply except where lawfully excluded.

8.2 IMMEDIATE PERFORMANCE

Many GoCareer Services involve:

  • personalised digital content;
  • bespoke written materials;
  • immediate professional consultation;
  • customised career documentation.

By requesting GoCareer to begin work immediately following purchase, the Client expressly requests immediate performance of the contract.

Where applicable law permits, the Client acknowledges that statutory cancellation rights may end once personalised services have commenced or digital content has begun to be supplied.

Nothing in these Terms excludes any mandatory consumer rights which cannot lawfully be excluded.

8.3 CANCELLATION BEFORE WORK COMMENCES

Where GoCareer has not yet commenced work, cancellation requests will be considered in accordance with applicable consumer legislation.

8.4 CANCELLATION AFTER WORK HAS COMMENCED

Once personalised work has commenced, cancellation shall not automatically entitle the Client to a refund.

GoCareer may deduct reasonable charges reflecting work already completed where permitted by applicable law.

9. REFUND POLICY

9.1 GENERAL PRINCIPLE

GoCareer provides highly personalised professional services.

Accordingly, once work has commenced, fees are generally non-refundable except:

  • where required by applicable law;
  • where GoCareer expressly agrees otherwise in writing; or
  • where these Terms specifically provide for a refund.

9.2 GUARANTEES ARE NOT REFUND GUARANTEES

Unless expressly stated otherwise in writing, the Interview Guarantee, Job Offer Guarantee, and Job Loss Protection are service continuation commitments.

They do not constitute refund guarantees.

Where a Client does not achieve the applicable milestone within the relevant guarantee period, GoCareer’s obligation is to continue providing the applicable support described in Section 13 rather than issuing a refund.

9.3 CHANGE OF MIND

No refund shall be available where the Client:

  • changes career direction;
  • no longer wishes to seek employment;
  • obtains employment independently;
  • decides not to continue searching;
  • becomes unavailable;
  • chooses not to use completed Career Materials.

9.4 DISSATISFACTION

Where a Client is dissatisfied with the Services, GoCareer will use reasonable efforts to resolve the concerns through discussion, revision, or additional support where appropriate.

This clause does not limit any statutory consumer rights.

10. DELIVERY OF SERVICES

10.1 ESTIMATED TIMESCALES

Any delivery timeframe published by GoCareer represents an estimate only unless expressly stated otherwise.

10.2 CLIENT DELAYS

Where delivery is delayed because the Client:

  • provides incomplete information;
  • fails to approve documents;
  • becomes unavailable;
  • fails to attend meetings;
  • delays responses;

delivery times shall automatically extend by the period of delay.

10.3 REVISIONS

Where unlimited revisions are included within a purchased package, such revisions shall relate solely to the agreed project scope.

Unlimited revisions do not include:

  • complete career changes;
  • new industries;
  • additional job families outside the original agreed scope;
  • substantial rewriting arising from new information supplied after approval.

Where changes exceed the original scope, GoCareer may charge additional fees.

11. SERVICE STANDARDS

GoCareer shall exercise reasonable skill and care in providing the Services.

However, GoCareer does not warrant or guarantee:

  • that interviews will be obtained;
  • that employment will be secured;
  • that salary expectations will be achieved;
  • that employers will respond to applications;
  • that employers will follow recruitment timetables;
  • that any recruitment process will continue to completion.

Employment outcomes depend upon numerous external factors beyond GoCareer’s reasonable control, including employer decisions, market conditions, competition, economic circumstances, immigration requirements, legal restrictions, and the Client’s own experience, qualifications, performance, and availability.

Except where expressly provided under Section 13 (Guarantees), GoCareer’s obligations are limited to providing the Services with reasonable care and skill in accordance with these Terms. Nothing in this Agreement shall be interpreted as creating a promise or guarantee of employment, interviews, or job offers.

12. ELEVATE PROGRAMME

12.1 PROGRAMME OVERVIEW

The Elevate Programme is GoCareer’s managed career transition service designed to assist Clients in improving their employment prospects through a structured programme of professional career support.

Depending upon the package purchased, the Programme may include:

  • career consultation;
  • career strategy development;
  • CV preparation;
  • cover letter preparation;
  • LinkedIn profile optimisation;
  • interview preparation;
  • career coaching;
  • managed job application services;
  • employer opportunity identification;
  • salary negotiation guidance;
  • ongoing career support; and
  • applicable Guarantees described in these Terms.

The precise Services included shall be those identified within the Client’s purchased package.

12.2 NATURE OF THE PROGRAMME

The Client acknowledges that the Elevate Programme is a professional consultancy service and not an employment placement service.

GoCareer agrees to provide professional guidance, career documentation, managed support, and strategic assistance using reasonable skill and care.

GoCareer does not:

  • employ Clients;
  • recruit on behalf of employers;
  • control recruitment decisions;
  • guarantee employer responses; or
  • guarantee employment outcomes except as expressly provided through the service continuation Guarantees contained within these Terms.

13. GUARANTEE FRAMEWORK

13.1 NATURE OF GUARANTEES

Where included within an eligible package, GoCareer provides certain service continuation Guarantees.

Each Guarantee represents GoCareer’s commitment to continue providing specified professional support where the relevant milestone has not yet been achieved within the applicable guarantee period.

The Guarantees are intended to provide Clients with additional confidence in the quality and continuity of GoCareer’s Services.

The Guarantees:

  • are contractual service commitments;
  • are not insurance products;
  • are not financial guarantees;
  • are not employment guarantees;
  • are not recruitment guarantees;
  • are not promises that interviews or employment will be obtained.

GoCareer’s obligation under any Guarantee is limited to providing the continued support expressly described within these Terms.

13.2 EXTERNAL FACTORS

The Client acknowledges that recruitment outcomes depend upon numerous factors beyond GoCareer’s reasonable control including:

  • employer hiring decisions;
  • economic conditions;
  • labour market demand;
  • industry recruitment activity;
  • geographic location;
  • competition from other applicants;
  • salary expectations;
  • immigration requirements;
  • right-to-work requirements;
  • security clearance requirements;
  • employer budget changes;
  • restructuring;
  • withdrawal of vacancies;
  • interview performance; and
  • the Client’s qualifications, experience, conduct, and availability.

Accordingly, no Guarantee shall be interpreted as guaranteeing employment, interviews, or offers.

14. 60-DAY INTERVIEW GUARANTEE

14.1 ELIGIBILITY

The Interview Guarantee applies only where expressly included within the purchased package.

14.2 COMMENCEMENT

The guarantee period commences on the date the first managed job application is submitted by GoCareer on the Client’s behalf under the Elevate Programme.

14.3 SUCCESSFUL COMPLETION

The Interview Guarantee shall be deemed successfully fulfilled once the Client receives at least one qualifying Interview during the guarantee period.

14.4 CONTINUED SUPPORT

Where the Client does not obtain a qualifying Interview within sixty (60) calendar days, and remains eligible under these Terms, GoCareer shall continue providing additional support without additional programme fees.

Such support may include:

  • review of target roles;
  • review of application strategy;
  • refinement of Career Materials;
  • keyword optimisation;
  • CV improvements;
  • cover letter improvements;
  • LinkedIn optimisation;
  • career coaching;
  • interview preparation;
  • market positioning advice; and
  • continued strategic guidance.

GoCareer shall determine the most appropriate combination of support having regard to the Client’s circumstances.

Continued support shall continue until:

  1. the Client secures a qualifying Interview;
  2. the Client becomes ineligible;
  3. the agreement is terminated in accordance with these Terms; or
  4. the Client otherwise ceases participating in the Programme.

15. 6-MONTH JOB OFFER GUARANTEE

15.1 ELIGIBILITY

The Job Offer Guarantee applies exclusively to Clients purchasing an eligible Elevate Pro package.

15.2 COMMENCEMENT

The guarantee commences upon submission of the first managed application by GoCareer.

15.3 SUCCESSFUL COMPLETION

The Guarantee shall be fulfilled where the Client receives a qualifying Job Offer within six (6) calendar months.

15.4 CONTINUED SUPPORT

Where no qualifying Job Offer has been obtained within the guarantee period, GoCareer shall continue providing professional career support without additional programme fees for a further period of up to six (6) months, or until the Client secures a qualifying Job Offer, whichever occurs first. This aligns with the current Elevate Programme description.

Support may include:

  • career strategy review;
  • market analysis;
  • refinement of Career Materials;
  • interview coaching;
  • employer targeting;
  • managed job search support (where applicable);
  • application strategy review;
  • interview feedback analysis;
  • salary negotiation guidance; and
  • ongoing professional coaching.

This Guarantee does not entitle the Client to a refund unless otherwise required by applicable law or expressly agreed in writing by GoCareer.

16. 1-YEAR JOB LOSS PROTECTION

16.1 ELIGIBILITY

Job Loss Protection applies only where expressly included within the purchased package.

16.2 PROTECTION PERIOD

The protection period commences on the Client’s first day of employment in the role secured through the Elevate Programme.

Protection continues for twelve (12) consecutive months.

16.3 QUALIFYING JOB LOSS

Job Loss Protection applies where employment ends involuntarily due to circumstances outside the Client’s reasonable control, including:

  • redundancy;
  • organisational restructuring;
  • business closure;
  • genuine role elimination; or
  • similar involuntary loss of employment.

16.4 EXCLUSIONS

Job Loss Protection does not apply where employment ends because of:

  • voluntary resignation;
  • retirement;
  • dismissal for gross misconduct;
  • dismissal arising from deliberate or serious misconduct;
  • expiry of a fixed-term contract known at commencement (unless otherwise agreed in writing);
  • self-employment ending;
  • voluntary career break.

16.5 NOTIFICATION

The Client shall notify GoCareer as soon as reasonably practicable and, where possible, within fourteen (14) calendar days of becoming aware of the qualifying job loss.

GoCareer may request reasonable evidence confirming eligibility.

16.6 REACTIVATED SUPPORT

Where eligibility is confirmed, GoCareer shall reactivate professional career support without additional programme fees.

Support may include:

  • CV updates;
  • LinkedIn updates;
  • career strategy;
  • interview coaching;
  • job search guidance;
  • application support;
  • market advice; and
  • career planning.

17. MANAGED APPLICATION SERVICES

17.1 APPLICATION ALLOCATION

Where a package includes managed applications, those applications form part of the overall Programme rather than a standalone service.

Current allocations are:

  • Elevate Lite: up to ten (10) managed applications.
  • Elevate Pro: up to twenty (20) managed applications.

17.2 EXHAUSTION OF ALLOCATION

Once the included allocation has been used, GoCareer shall notify the Client.

Where additional managed application services are available, GoCareer may offer the Client the opportunity to purchase additional application support.

17.3 EFFECT ON GUARANTEES

Where managed application activity pauses because the included allocation has been exhausted, GoCareer and the Client shall work together in good faith to determine the most appropriate continuation strategy.

Where additional application services are purchased, guarantee periods shall resume from the date application activity recommences.

Where additional application services are not purchased, the Client may remain eligible for applicable Guarantees provided they continue participating actively in the agreed job search strategy and comply with their obligations under these Terms. GoCareer may require reasonable evidence of ongoing job search activity where managed applications are no longer being provided.

18. INTELLECTUAL PROPERTY

18.1 OWNERSHIP

Unless otherwise agreed in writing, all intellectual property rights in:

  • methodologies;
  • templates;
  • processes;
  • software;
  • systems;
  • workflows;
  • educational materials;
  • coaching materials;
  • strategy documents;
  • branding;
  • website content; and
  • all materials created by GoCareer,

remain the exclusive property of GoCareer or its licensors.

18.2 LICENSE

Upon receipt of full payment, GoCareer grants the Client a non-exclusive, non-transferable, revocable licence to use the Career Materials solely for the Client’s own personal career development and job search.

The Client shall not:

  • sell;
  • sublicense;
  • distribute;
  • commercially exploit;
  • publish;
  • reproduce for commercial purposes; or
  • permit third parties to use

any GoCareer materials without prior written consent.

18.3 CLIENT CONTENT

The Client retains ownership of documents and information supplied to GoCareer.

The Client grants GoCareer a non-exclusive licence to use such information for the purpose of providing the Services.

The Client warrants that they have the legal right to provide all materials supplied.

19. CONFIDENTIALITY

Each party agrees to keep confidential all non-public information received from the other party during the provision of the Services.

Confidential Information includes:

  • commercial information;
  • business strategies;
  • pricing;
  • career documentation;
  • interview preparation;
  • personal information;
  • technical information;
  • proprietary methodologies.

Neither party shall disclose Confidential Information except:

  • where required by law;
  • where necessary to perform these Terms;
  • with prior written consent;
  • to professional advisers under confidentiality obligations.

This obligation survives termination for six (6) years.

20. DATA PROTECTION

GoCareer processes personal data in accordance with:

  • the UK General Data Protection Regulation;
  • the Data Protection Act 2018; and
  • its published Privacy Policy.

Personal data shall be processed only where lawful and necessary for:

  • providing the Services;
  • customer support;
  • billing;
  • legal compliance;
  • legitimate business purposes.

The Client is responsible for ensuring that any personal information supplied to GoCareer is accurate and up to date.

Nothing in these Terms limits any rights available under applicable data protection legislation.

21. RESULTS DISCLAIMER

GoCareer provides professional career consultancy services.

GoCareer does not guarantee:

  • employment;
  • interviews (except as expressly covered by an applicable service continuation Guarantee);
  • salary levels;
  • promotion;
  • employer responses;
  • recruitment outcomes.

Recruitment decisions remain exclusively within the control of third-party employers.

Historic client success rates, testimonials, and case studies are provided for illustrative purposes only and do not constitute guarantees of future performance or outcomes.

22. LIMITATION OF LIABILITY

22.1 REASONABLE SKILL AND CARE

GoCareer shall perform the Services with reasonable skill and care.

22.2 EXCLUDED LOSSES

To the fullest extent permitted by law, GoCareer shall not be liable for:

  • indirect loss;
  • consequential loss;
  • loss of profit;
  • loss of earnings;
  • loss of opportunity;
  • loss of business;
  • loss of reputation;
  • loss arising from employer decisions;
  • delays caused by third parties;
  • market changes;
  • immigration restrictions;
  • legal restrictions;
  • changes in recruitment conditions.

22.3 LIABILITY CAP

Subject to Section 22.4, GoCareer’s total aggregate liability arising from or in connection with the Services shall not exceed the total fees paid by the Client under the relevant agreement.

This limitation applies whether liability arises in contract, tort (including negligence), breach of statutory duty or otherwise.

22.4 NON-EXCLUDABLE LIABILITY

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any liability which cannot lawfully be excluded or limited under applicable law.

23. FORCE MAJEURE

GoCareer shall not be liable for any delay or failure in performing its obligations where such delay or failure results from events beyond its reasonable control.

These may include:

  • natural disasters;
  • pandemics;
  • industrial disputes;
  • power failures;
  • internet outages;
  • cyber attacks;
  • governmental action;
  • changes in law;
  • war;
  • terrorism;
  • civil unrest;
  • failure of suppliers or technology providers.

Performance shall resume as soon as reasonably practicable.

24. SUSPENSION AND TERMINATION

GoCareer may suspend or terminate the Services where the Client:

  • materially breaches these Terms;
  • fails to make payment;
  • becomes abusive or threatening;
  • provides fraudulent information;
  • misuses the Services;
  • repeatedly fails to engage with the Programme.

Where reasonably practicable, GoCareer will provide written notice and an opportunity to remedy the breach before termination, unless the breach is serious or incapable of remedy.

Termination shall not affect accrued rights or obligations.

25. COMPLAINTS

If the Client is dissatisfied with any aspect of the Services, they should notify GoCareer in writing as soon as reasonably practicable.

GoCareer will investigate complaints fairly and aim to respond within a reasonable timeframe.

Both parties agree to attempt to resolve disputes through good-faith discussion before commencing legal proceedings, without affecting either party’s statutory rights or access to the courts.

26. GENERAL PROVISIONS

26.1 ENTIRE AGREEMENT

These Terms, together with any written proposal accepted by the Client and GoCareer’s Privacy Policy, constitute the entire agreement between the parties.

26.2 VARIATION

GoCareer may amend these Terms from time to time.

Changes shall not materially affect Services already purchased unless:

  • required by law;
  • necessary for regulatory compliance; or
  • agreed with the Client.

Material changes affecting ongoing contracts will be communicated to affected Clients.

26.3 SEVERABILITY

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

26.4 WAIVER

Failure by either party to enforce any provision shall not constitute a waiver of future enforcement.

26.5 ASSIGNMENT

The Client may not assign or transfer rights under these Terms without GoCareer’s prior written consent.

GoCareer may assign or transfer its rights and obligations provided this does not adversely affect the Client’s statutory rights.

26.6 THIRD PARTY RIGHTS

A person who is not a party to these Terms shall have no right to enforce any provision under the Contracts (Rights of Third Parties) Act 1999.

26.7 GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

26.8 JURISDICTION

Subject to any mandatory consumer rights regarding jurisdiction, the courts of England and Wales shall have exclusive jurisdiction to determine any dispute arising out of or in connection with these Terms.

28. FINAL CONSUMER RIGHTS SAVINGS CLAUSE

Nothing in these Terms shall exclude, restrict or limit any statutory rights or remedies available to consumers under applicable law, including but not limited to the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Data Protection Act 2018, the UK General Data Protection Regulation, or any other mandatory consumer protection legislation.

Where any provision of these Terms conflicts with mandatory law, the mandatory law shall prevail to the extent of the inconsistency, and the remaining provisions shall continue in full force and effect.
